We Mean Business
The Birch Run High School team was preparing for this year's Saginaw County Law Day mock trials, but unfortunately it was canceled. Most of our students are juniors or underclassmen, so they'll get another shot next year.
The case involves cyberbullying on a college chatboard. Someone made threatening statements against a student. The tough issue in the case is whether the defendant made the threats or whether someone else used his account without his knowledge. Mock trial students learn a great deal about courtroom procedure. For example, the accompanying photo shows Irving Younger's Ten Commandments of Cross Examination. The students had mapped out the entire case on the windows of the physics classroom. It's unfortunate the case won't go forward this year.

On November 22, 2019, Mott students Kenni Sadler and Tracy Fischer competed in the American Moot Court Association regional at Saginaw Valley State University. Kenni and Tracy were very brave as they were the first MCC students to compete.
The students argued two legal issues, pretending the case was before the Supreme Court. The first issue was whether the Fourth Amendment prohibited the warrantless search of cell phone records when it was likely the suspects would be leaving town soon. The second issue involved a law that forbade witnesses under the age of ten from testifying. The legal issue was whether the Sixth Amendment's right to confront witnesses meant the defendant had a right to question the underage witness. The students presented their arguments three times. Each team argues the case for the prosecution and the defense, and a third time where a coin toss decides the side. We hope this becomes an MCC tradition. Students have expressed an interest in participating next fall. I'd like to thank Tracy and Kenni for participating. They worked very hard getting ready and the competition itself is nerve wracking. However, it's a good experience and they learned a lot. |
